LASER SPINE INSTITUTE SCHOLARSHIP PROGRAM TERMS AND CONDITIONS

Definitions

  • LSI: Laser Spine Institute, LLC together with its affiliated entities, commonly owned entities, and parent entity.
  • LSI Employee: Any person currently employed by LSI as defined above.
  • LSI Family Member: Any person related to an LSI Employee by blood or marriage which includes but not limited to, father (including in-law), mother (including in-law), husband, wife, domestic partner, children (whether natural or adopted), sibling (including in-law), uncle, aunt, nephew, niece and first cousin.
  • Scholarship: The Laser Spine Institute Scholarship program offered by LSI to eligible Applicants.
  • Award: One Thousand Five Hundred Dollars ($1,500.00) given to the winner of the Scholarship.
  • Application: Comprised of Applicant’s official transcripts from his/her university or college, a 750-1,000-word essay on the assigned topic, a signed application form and acknowledgment of terms and conditions.
  • Applicant: Eligible student who submits an Application for the Laser Spine Institute Scholarship.
  • Entry Period: August 15th (12:00AM EDT) through June 15th (11:59PM EDT).
  • LSI Scholarship Panel: A panel of four judges selected by LSI to review the Applications.

Scholarship Eligibility

All Applicants must:

  • Be currently enrolled as a full-time student at a university or college for the current school year and intend to continue such enrollment for the subsequent school year.
  • Be seeking a degree in a health or science based program, with an interest in pursuing a career in healthcare.
  • Currently have a minimum 3.5 GPA at a university or college.
  • Have an active .edu email address for the university or college they attend.
  • Submit official transcripts from his or her university or college
  • Submit a 750 – 1,000 word essay on the assigned topic
  • Complete and sign the application form
  • Sign the acknowledgement of the terms and conditions
  • Submit a complete Application to Scholarship@Laserspineinstitute.com during the Entry Period..

LSI reserves the right to amend, alter, update or revise these terms and conditions at its discretion without notice. LSI holds the right to terminate these terms and conditions, and the Scholarship, at any time without cause and without notice.

How to Enter

To apply for the Scholarship, Applicant must submit a complete Application during the Entry Period. All email submissions must be sent in before 11:59PM on June 15th. Limit to one (1) entry per Applicant.

All Applications must be: submitted in English, legible, the Applicant’s original creation, true and verifiable, and created solely by Applicant. LSI reserves the right, in its sole discretion, to disqualify any Application it deems to be inappropriate, offensive or is not in keeping with LSI’s values.

All eligible Applications received within the Entry Period will be reviewed by the LSI Scholarship Panel. The LSI Scholarship Panel decisions will be final and binding in all matters relating to this contest.

Award

The winning Application will be chosen by the LSI Scholarship Panel on August 1st.

The winning Applicant will be notified by phone and email by August 15th. The winning Applicant has 15 days to respond to the phone call and/or email to accept the Award. If Applicant fails to respond to LSI within those 15 days, Applicant will be disqualified from winning the Award.

Upon winning, LSI will distribute the Award to the Applicant’s university or college and the Award shall be applied to the Applicant’s student account. All federal, state and local taxes and any other costs and expenses not specifically stated herein as being awarded are the winning Applicant’s sole responsibility. There may be no transfer, assignment, or substitution of the Award. However, LSI may substitute the Award with one of equal or greater value, at its sole discretion. The terms and conditions relating to the distribution and allocation of the Award are determined by LSI in its sole discretion.

Disclaimer

Winning the Scholarship is contingent upon full compliance with these terms and conditions. LSI Employees and LSI Family Members are not eligible to apply for the Scholarship. Applicant is responsible for any and all fees and costs connected with the Application for this Scholarship.

By submitting an Application, Applicant agrees LSI, its affiliates, contractors, and representatives shall own the Application submitted, and all materials contained therein (and all rights embodied therein), and that it and its representatives may utilize, edit, modify, and distribute the Application and all elements of such entry, including, without limitation, the names and likenesses of any persons or locations embodied therein, in any and all media now known or not currently known, throughout the world in perpetuity without compensation, permission or notification to Applicant or any third party.

General Release

By submitting an Application, each Applicant agrees (a) to be bound by these terms and conditions (b) the decisions of the LSI Scholarship Panel, shall be final, non-reviewable and binding in all respects; © to defend, release and hold harmless LSI, its owners, directors, officers, employees and agents (the “Released Parties”), from and against any and all claims, demands, suits, proceedings, liabilities, judgments, losses, damages, expenses and costs (including without limitation reasonable attorneys’ fees) assessed or incurred by LSI, directly or indirectly, with respect to, or arising out of: (i) your failure to comply with, or your breach of these terms and conditions; (ii) your use of the rights granted hereunder, including without limitation any claims made by any third parties, by reason of Applicant’s participation or submission of an Application; (iii) the use of any Application or acceptance, possession, use or misuse of an Award, and/or (iv) any claims based on rights of privacy, rights of publicity and/or copyright infringement; and (d) if he/she wins the Scholarship, LSI and its affiliates and contractors, may use his/her name, city and state of residence, likeness and biographical information for advertising and promotion purposes in any and all media now or hereafter known throughout the world in perpetuity, without additional compensation, notification permission, unless prohibited by law.

Should any portion of the Scholarship be, in LSI’s sole opinion, compromised by non-authorized human intervention or other causes which, in the sole opinion of the LSI, corrupt or impair the administration, security, fairness, or submission of Applications, LSI reserves the right at its sole discretion to suspend, modify or terminate the Scholarship and select the potential winners from all eligible, non-suspect entries received prior to such action using the judging procedure outlined above. Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, submissions.

Released Parties are not responsible for printing, typographical, technical, telephonic, computer, human, network or other errors relating to or in connection with the Scholarship, including, without limitation, errors which may occur in any scholarship program related materials, the administration of the Scholarship, the processing or judging of Applications or the announcement of the Award; for stolen, lost, late, misdirected, inaccurate, undelivered, damaged, delayed, garbled, illegible, incomplete or postage-due entries or mail. Released Parties are not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received on account of technical problems, human error or traffic congestion on the Internet or at any web site, or any combination thereof, including any injury or damage to individual’s or any other person’s computer relating to or resulting from participation in this Scholarship or downloading any materials in this scholarship program. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SCHOLARSHIP IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

Arbitration

These terms and conditions shall be governed by and construed under the laws of the State of Florida, notwithstanding its conflict of law provisions. All actions or proceedings arising in connection with, touching upon or relating to these terms and conditions, the breach thereof and/or the scope of the provisions of this Section shall be submitted to American Arbitration Association (“AAA”) for binding arbitration under its Comprehensive Arbitration Rules and Procedures if the matter in dispute is over $250,000, or under its Streamlined Arbitration Rules and Procedures if the matter in dispute is $250,000 or less, to be held solely in Hillsborough County, Florida, United States, in the English language in accordance with the following provisions: (i) Each arbitration shall be conducted before a three-arbitrator panel which will be selected as follows: one arbitrator shall be selected by LSI, one arbitrator shall be selected by Applicant, and one arbitrator shall be selected by AAA, which arbitrator shall control all discovery and evidentiary discovery; all judges shall be either retired judges or attorneys with at least ten years of practice; (ii) LSI and Applicant (collectively, the “Parties”) shall share the costs of the arbitration; and (iii) THE PARTIES HEREBY WAIVE THEIR RIGHT TO JURY TRIAL WITH RESPECT TO ALL CLAIMS AND ISSUES ARISING UNDER, IN CONNECTION WITH, TOUCHING UPON OR RELATING TO THESE TERMS AND CONDITIONS, WHETHER SOUNDING IN CONTRACT OR TORT, AND INCLUDING ANY CLAIM FOR FRAUDULENT INDUCEMENT THEREOF.

The arbitrator(s) shall apply Florida law to the merits of any dispute or claim, without reference to conflicts of law rules. Applicant and LSI hereby consent to the personal jurisdiction of the state and federal courts located in Florida for any action or proceeding arising from or relating to these terms and conditions or relating to any arbitration in which the Parties are participants.

Applicant and LSI shall each pay one-half of the costs and expenses of such arbitration, and each shall separately pay its counsel fees and expenses unless otherwise required by law.

The Parties may apply to any court of competent jurisdiction for a temporary restraining order, preliminary injunction, or other interim or conservatory relief, as necessary, without breach of this arbitration agreement and without abridgment of the powers of the arbitrator.

APPLICANT HAS READ AND UNDERSTAND THESE TERMS AND CONDITIONS, WHICH DISCUSSES ARBITRATION. APPLICANT UNDERSTANDS THAT BY SIGNING THESE TERMS AND CONDITIONS, APPLICANT AGREES TO SUBMIT ANY CLAIMS ARISING OUT OF, RELATING TO, OR IN CONNECTION WITH THESE TERMS AND CONDITIONS, OR THE INTERPRETATION, VALIDITY, CONSTRUCTION, PERFORMANCE, BREACH OR TERMINATION THEREOF, TO BINDING ARBITRATION, EXCEPT AS PROVIDED IN THE PRECEDING PARAGRAPH AND THAT THIS ARBITRATION CLAUSE CONSTITUTES A WAIVER OF TERMS AND CONDITIONS TO A JURY TRIAL AND RELATES TO THE RESOLUTION OF ALL DISPUTES RELATING TO ALL ASPECTS OF THE RELATIONSHIP BETWEEN THE PARTIES.

Compliance with Laws

The Parties acknowledge and agree that any benefit gained by either Party under this Agreement is not intended to be nor should be construed to be an inducement or payment for referral of, or for recommending referral of patients. The Parties intend at all times that payments and other remuneration made pursuant to this Agreement shall be in compliance with Florida law and the Anti-Kickback Statute as set out at 42 U.S.C. 1320a-7b(b).
